New River Valley Unwired, LLC (NRVU) Internet Service Privacy Statement

NRVU’s wireless internet service provides customers with high speed access to the global Internet. NRVU takes protection of Customer’s privacy seriously. The following statement applies to the Customer as a subscriber to NRVU Internet services and informs the Customer of the information that NRVU collects, how NRVU uses it, protects it and the limited cases where NRVU may disclose some of that information.  Please review this privacy statement in conjunction with our Customer Agreement.

 

What type of information does NRVU collect?

NRVU collects information about the Customer when: (a) it is necessary to provide our services to them; (b) the Customer voluntarily provides information to NRVU; or (c) to prevent unauthorized reception of services. This information includes both personally identifiable information and non-personal information.

 

Personally identifiable information - Personally identifiable information necessary to provide services includes customer name; address; telephone numbers; social security number; billing; service and credit records; customer correspondence; the services Customer subscribes to and uses; the purchases the Customer makes over the system and the types and number of devices the Customer uses to connect to the system (e.g., computers or other network-enabled devices). To provide Customer with a more personalized experience, NRVU may collect personal information such as Customer’s locale and service preferences the Customer indicates through their voluntary interaction with the system. By using NRVU’s interactive digital services, the Customer consents to our collection of this information. NRVU may also collect additional personally identifiable information from third parties to enhance our customer database, and NRVU may maintain research records containing information obtained through voluntary subscriber interviews or surveys.

 

Non-personal information - Non-personal information, including aggregate information about our customers obtained from other sources, does not identify individual customers. NRVU may combine this data with our business records as necessary to better serve our customers.

 

Why does NRVU collect personally identifiable information?

NRVU collects personally identifiable information to provide the Customer with accurate and high quality customer service, properly deliver the Customer’s services and protect the security of the system. For example, information on the Customer’s connections to our system makes it possible for Customer Premise Equipment to receive and process the signals for the services the Customer orders. Additional information also allows NRVU to tailor our services, as well as develop and market new services, to better fit the Customer’s needs. Finally, NRVU also uses personally identifiable information to maintain our accounting and tax records.

 

Who sees the information collected by NRVU?

NRVU will only disclose personally identifiable information to others if: (a) the Customer provides written or electronic consent in advance, or (b) it is permitted under federal law. Specifically, federal law allows NRVU to disclose personally identifiable information to third parties when it is necessary to provide NRVU’s services or to carry out NRVU’s business activities. People that have authorized access to the Customer’s information include our employees; billing and collection services, installation, repair and subscriber assistance subcontractors or agents, software vendors, program and other service suppliers for audit purposes, marketers of NRVU’s products and services, our attorneys and accountants, entities affiliated through common ownership or control with NRVU or strategic partners offering or providing products or services jointly or on behalf of NRVU. The frequency of disclosures varies according to business needs, and may involve access on a regular basis.

 

If allowed by and after complying with federal law requirements, NRVU may disclose personally identifiable information about the Customer to representatives of government or to comply with a court order. Disclosures to representatives of government may be made pursuant to an administrative subpoena, warrant, court order, our reasonable discretion in cases of emergency or serious physical injury, or other permitted means if allowed under the laws applicable to the services to which the Customer subscribes. If federal law permits, NRVU will notify the Customer of such disclosure.

 

Except as noted above, NRVU will not sell, share or otherwise disclose personal information to others.

 

How long does NRVU maintain personally identifiable information?

NRVU will maintain personally identifiable information about the Customer only as long as it is necessary for the purpose for which it was collected; to comply with laws governing our business, including tax and accounting laws; to satisfy pending requests or orders for access by a subscriber to his/her information or pursuant to a court order.

 

How does NRVU protect customer information?

NRVU uses security/encryption technology to secure personally identifiable information collected over the system. NRVU also maintains our customer database in a restricted area and secures the content by use of firewalls and other security methods. NRVU limits access to databases containing subscribers’ personally identifiable information to those specifically authorized employees and agents of NRVU and other parties identified in the disclosure section above.

 

Can I see the information that NRVU collects about me?

The information NRVU has about the Customer is maintained at our office. If the Customer would like to see this information, please send NRVU a written request. NRVU will be glad to make an appointment for the Customer to come in to our local office during regular business hours. If the Customer’s review reveals an error in our records, NRVU will correct it. The Customer may also be able to access certain information about themselves over the system, depending upon the information the Customer has provided (e.g., information the Customer has provided to process an order made via the system, etc.).

 

Can any other parties collect information from me over the system?

Unless the Customer provides written or electronic consent, content providers not affiliated with NRVU that provide goods, services, other content over our network are contractually bound not to collect the Customer’s personally identifiable information without the Customer’s consent. If the Customer consents to the collection, these providers can only use the Customer’s personally identifiable information to fulfill the Customer’s order or request. They cannot disclose the Customer’s personally identifiable information for any other purpose and they may not use the Customer’s information to directly contact the Customer or to solicit sales of other goods or services to our customers.

 

What if I have any questions?

If the Customer has any questions about our privacy protections and policies, please contact the Customer’s local customer service office.  The Customer can contact the Company at the phone number listed on NRVU’s website at www.nrvunwired.net.  If the Customer believes that NRVU has violated our limitations and responsibilities under federal law, the Customer may also have the right to bring an action in Federal District Court.
